Terms of Service

These Terms govern your use of GoMining Simulator ("the Site", available at gmsim.ca). By creating an account or using the Site you agree to these Terms. If you do not agree, do not use the Site.

1. What the Site Is

GoMining Simulator is a free, independent profitability calculator and strategy explorer for users of the GoMining NFT mining platform. We are not affiliated with, endorsed by, or partnered with GoMining or any of its operators. All trademarks belong to their respective owners.

3. Accounts

• You must provide a valid email address (via Google or magic link) to use the Site.
• You are responsible for activity under your account. Don't share access.
• You must be at least 13 years old (or the age of digital consent in your country).
• We may suspend or delete accounts that violate these Terms or applicable laws.

4. Acceptable Use

You agree NOT to:

• Use the Site for any illegal purpose.
• Attempt to gain unauthorized access to other users' data, the admin dashboard, or our infrastructure.
• Scrape, copy, or systematically extract Site content beyond personal use.
• Reverse engineer, modify, or create derivative works for resale.
• Inject malware, run automated bots, or stress the Site beyond normal use.
• Click ads in a fraudulent or automated manner.

5. Intellectual Property

Site code, design, branding, and original content are owned by the Site operators. You receive a personal, non-exclusive, non-transferable license to use the Site for its intended purpose. We retain all other rights.

6. User-Submitted Data

Any data you enter (mining scenarios, portfolio values, etc.) remains yours. By saving it on the Site, you grant us a limited license to store, display, and process it solely to provide the service to you.

7. Third-Party Services and Data

The Site fetches data from public APIs (e.g. blockchain.info, exchange rates, mining-pool stats). We do not control those services and cannot guarantee accuracy or availability. The Site may go down without notice if upstream services do.

8. Advertising

The Site is supported by advertising served by Google AdSense. We do not endorse advertised products. See our Privacy Policy for how ads work and how to opt out of personalization.

9. Disclaimer of Warranties

The Site is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or that calculations will be correct.

10. Limitation of Liability

To the maximum extent permitted by law, the Site operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of your use of the Site. Our total liability for any claim arising under these Terms is limited to USD $50.

11. Indemnification

You agree to indemnify and hold harmless the Site operators from any claim or demand made by any third party arising from your misuse of the Site or violation of these Terms.

12. Termination

We may suspend or terminate your access at any time for any reason, including violation of these Terms. You may delete your account at any time by emailing us.

13. Changes to These Terms

We may update these Terms periodically. The "Last updated" date will reflect changes. Continued use after changes means you accept the new Terms.

14. Governing Law

These Terms are governed by the laws of the Province of Quebec, Canada, without regard to conflict-of-law principles. Disputes will be resolved in the courts of Quebec.
